What is the PSGA?

Before looking at the different licences, it is worth checking a definition of the PSGA:

The Public Sector Geospatial Agreement (PSGA) is a contract between the Geospatial Commission on behalf of the Public Sector, in England, Wales and Scotland and Ordnance Survey. It allows for Public Sector Members, to access, use and share our constantly evolving location data. ​

As a member you are permitted to…​

  • Use Ordnance Survey data in your day-to-day activities to support your day-to-day activities and meet your public task.​

  • Share Ordnance Survey data, and derived data with other PSGA members.​

  • Share your Ordnance Survey data, and derived data with anybody who is involved in providing immediate response in an emergency situation even if they are not a PSGA member.​

  • Share Ordnance Survey data, and derived data with third parties including, contractors, end users, public viewing and meeting INSPIRE obligations.​

  • In many circumstance you can publish your derived data.​

As a member you must not…

  • Use Ordnance Survey data to make any financial gain or profit from your activity.​

  • Use Ordnance Survey data in any competing activity.​

  • Use Ordnance Survey data beyond what is permitted in the PSGA members licence.

What is the End User Licence?

Use the public sector end user licence for individuals, voluntary and community groups or other similar bodies who need to use data to respond to or interact with you to deliver or support the delivery of your core business.

This licence covers the supply of AddressBase products to the extent that any PAF data within the AddressBase or AddressBase derived data is “cleansed data” (refer to the “Database Cleansing” definition in Part A of Appendix 3 in the PSGA Member Licence).

What is the Public Sector Contractor Licence?

The Public Sector Contractor Licence should be used where a contractor provides works or services to you under a formal agreement, which is typically charged.

This licence doesn’t allow the contractor to make additional money, take part in competing activities or publication.

This data provided under this licence can only be used for the contract outlined in the licence.

Help! Its Clause 11.4 of the Public Sector Contractor Licence!

The aim of Clause 11.4 is to limit the liability between you, the PSGA Member and to the Contractor for those liabilities which aren’t covered in clauses:

11.1 death and personal Injury caused by negligence, and fraud.

11.3 Members liability to Ordnance Survey due to contractor defaults.

Examples of where clause 11.4 would apply :

The contractor introduces a virus to the member's system in breach of the contractor's licence.

The member introduces a virus to the contractor's systems in breach of the contractor's licence.
